Why a Fair Use Policy?

Markey is built to help individuals, startups, and teams generate marketing content quickly. To keep the service fast and affordable for everyone, we ask that all users follow these fair use guidelines.

What's Considered Fair Use

  • Generating campaigns for products, projects, or businesses you own or represent
  • Using generated content across your own marketing channels
  • Editing, remixing, and adapting generated content to fit your needs
  • Regenerating content to iterate on tone, messaging, or format
  • Using the API within your plan's rate limits for your own applications

What Falls Outside Fair Use

  • Bulk generation for resale — Using Markey to mass-produce content for sale to third parties as a service
  • Automated scraping — Submitting URLs in bulk via scripts or bots beyond your plan's intended limits
  • Abuse of regeneration — Excessively regenerating the same content to circumvent usage limits
  • Impersonation — Generating content that falsely represents another brand or individual, including deepfakes, face-swaps, or voice clones of real people without their explicit consent
  • Harmful content — Using the Service to generate spam, misleading claims, fake reviews/testimonials, or content that violates applicable laws

Prohibited Content (Strict)

Markey is built for lawful, business-appropriate marketing. The following categories are never permitted on the platform, regardless of plan, intent, or framing. Attempting to generate this content — including via jailbreaks, indirect prompts, or workarounds — is grounds for immediate account termination without refund:

  • NSFW, sexually explicit, pornographic, or sexually suggestive contentin any medium (text, image, audio, video). This includes nudity, sexual acts, fetish content, erotic copy, and sexually-charged advertising creative. Markey does not provide and will not be marketed as offering an "uncensored," "no-filter," "NSFW," "18+," or "unfiltered" mode.
  • Any sexual or sexualized depiction of minors (CSAM), real or AI-generated. This is reported to the appropriate authorities.
  • Non-consensual intimate imagery, deepfakes, or face/voice manipulation of real people without documented consent.
  • Marketing for adult-industry products or services— pornography, escort services, adult dating, "OnlyFans"-style platforms, or sex toys promoted in an explicit manner.
  • Hate speech, harassment, or content inciting violence against people based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
  • Glorification of self-harm, suicide, or graphic violence.
  • Marketing for prohibited or restricted goods and services, including: illegal drugs and controlled substances, weapons, counterfeit goods, spyware/stalkerware, IPTV piracy, multi-level marketing schemes, essay/homework mills, unlicensed gambling, unlicensed financial/lending/legal/real-estate services, NFT or crypto pump schemes, and any product prohibited by our payment processor (Creem) or applicable law.
  • Fraud, phishing, scams, fabricated reviews/testimonials, or content designed to deceive consumers.
  • Malware, surveillance tools, or content promoting unauthorized access to systems or accounts.
  • Any content that infringes third-party intellectual property, privacy, or publicity rights, or that violates applicable law in your jurisdiction or the jurisdiction where the content will be published.

Generation requests are screened by automated moderation. Decisions to block, flag, or deny a request are final. Repeated attempts to bypass moderation will result in account termination. See our full Acceptable Use Policy for additional detail and examples.

Usage Limits

Each plan includes a set number of campaign generations per month. These limits are designed to accommodate normal usage patterns. If you consistently exceed your plan's limits, we may reach out to discuss upgrading to a plan that better fits your needs.

What Happens If You Exceed Fair Use

We believe in communication first. If we notice usage patterns that fall outside these guidelines, we'll reach out to you before taking any action. In most cases, this means a conversation about your use case and potentially upgrading your plan.

In extreme cases of abuse, we reserve the right to throttle, suspend, or terminate accounts that consistently violate this policy after being notified.
