Terms of Service

1. Agreement to Terms

By accessing or using Markey(the “Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Markey provides software-as-a-service tooling, including authentication, organization management, and billing utilities. We may modify, suspend, or discontinue features at our discretion.

3. Accounts

You must provide accurate registration information and keep your credentials confidential. You are responsible for activity that occurs under your account, including actions taken by members of organizations you administer.

4. Acceptable Use

Your use of Markey is also governed by our Acceptable Use Policy, which is incorporated into these Terms by reference. You agree not to use the Service, or any output of the Service, to:

• Generate, request, distribute, or solicit sexually explicit, pornographic, NSFW, or adult content of any kind, including nudity, sexual acts, sexually suggestive depictions, or content marketed as “adult,” “18+,” “uncensored,” or “unfiltered.”
• Generate or distribute child sexual abuse material (CSAM), non-consensual intimate imagery, or content that sexualises minors in any form.
• Create deepfakes, face-swaps, face manipulations, voice clones, or impersonations of real people without their explicit, documented consent.
• Generate violent, graphic, hateful, harassing, or discriminatory content, or content that promotes self-harm, terrorism, illegal activity, or the exploitation of any person.
• Transmit unlawful, harmful, defamatory, or infringing content, or content that violates the rights of third parties.
• Attempt to bypass rate limits, quotas, content moderation, safety filters, or any other security control of the Service, or market the Service to others as a way to do so.
• Reverse-engineer, decompile, or scrape the Service except where law expressly permits.
• Resell or sublicense the Service without our written consent.

Prompts submitted to Markey's AI generation features are screened by automated content moderation, including our payment partner's moderation systems, before any image or video is generated. Violations may result in prompt rejection, content removal, account suspension, or termination, and may be reported to law enforcement where required by law. Markey is fully responsible for the outputs its platform enables and does not accept “the model did it” as a defence; you are accountable for the prompts you submit.

5. Subscription, Billing, and Refunds

Paid plans are billed in advance on the cadence shown at checkout (monthly or annual). Charges are non-refundable except where required by law. You may cancel at any time from Settings → Billing (which opens the Creem customer portal); access continues through the end of the paid period. Failed payments may result in suspension after a grace period.

Payments are processed by Creem, our merchant of record. Refund requests should be sent to [email protected]. We respond to refund inquiries within 3 business days. Approved refunds are issued through Creem and may take 5–10 business days to appear on your statement.

6. User Content

You retain ownership of content you submit. You grant Markeya worldwide, non-exclusive license to host, process, and display that content solely to operate and improve the Service.

7. Intellectual Property

Markey, its logo, and all related software are the property of Markey. These Terms grant you a limited, non-transferable license to use the Service in accordance with our documentation.

8. Termination

We may suspend or terminate your access if you violate these Terms or if continued service exposes us to legal risk. You may terminate at any time by closing your account.

9. Disclaimers

The Service is provided “as is” without warranties of any kind, express or implied, to the maximum extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by law, Markey shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

11. Indemnification

You agree to indemnify and hold harmless Markey, its officers, and employees from claims arising out of your misuse of the Service or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of Netherlands, EU, without regard to conflict-of-law principles.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced by email or in-app notice. Continued use after the effective date constitutes acceptance.
