1. Acceptance of Terms
By accessing or using Markey ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
Markey is an AI-powered marketing content generation platform. You submit a URL, and the Service generates marketing materials including social media posts, launch copy, email campaigns, blog posts, visual assets, and ad creatives.
Markey is an independent product that provides a custom interface and additional features built on top of multiple third-party AI models (covering text, image, audio, and video generation). Markey is not itself an AI model, and we are not affiliated with, endorsed by, or sponsored by the providers of the underlying models. The set of models we use may change over time as we add features or upgrade quality.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account.
4. Content Ownership
You retain ownership of all content generated through Markey. We claim no intellectual property rights over the marketing materials created for you. You are free to use, modify, and distribute your generated content without restriction.
5. Acceptable Use
You agree not to use the Service, and not to permit anyone using your account to use the Service, to:
- Submit URLs to websites you do not own or have permission to analyze
- Attempt to reverse-engineer, decompile, or extract the underlying AI models
- Use automated systems to excessively access the Service beyond normal usage
- Resell or redistribute the Service itself without authorization
- Bypass, disable, or interfere with any safety, moderation, or content-filtering systems
6. Prohibited Content
Markey is a marketing content generation platform intended exclusively for lawful, business-appropriate use. You may not use the Service to generate, request, store, distribute, market, or facilitate any of the following — regardless of style, framing, or artistic intent:
- NSFW, sexually explicit, or pornographic content — including nudity, sexual acts, sexually suggestive imagery or copy, fetish content, erotic fiction, or any content intended to sexually arouse. This prohibition applies to text, images, audio, and video, and applies whether the subject is real or fictional.
- Child sexual abuse material (CSAM) or any sexualized content depicting minors, real or synthetic. This is strictly prohibited and will be reported to the appropriate authorities.
- Non-consensual intimate imagery, deepfakes, face-swaps, or face/voice manipulation of real people without their explicit, documented consent.
- Hate, harassment, or violent extremism — content that attacks, dehumanizes, or incites violence against people based on protected characteristics, or that promotes terrorist organizations.
- Self-harm, suicide, or graphic violence presented in a glorifying or instructional manner.
- Fraud, scams, deception, and impersonation — including phishing, fake reviews, fake testimonials, fabricated endorsements, misleading health/financial/legal claims, or content that falsely represents another brand or individual.
- Marketing for prohibited or restricted products — including but not limited to: illegal drugs, controlled substances, weapons and ammunition, tobacco/vaping products marketed to minors, counterfeit goods, spyware/stalkerware, IPTV piracy services, multi-level marketing schemes, essay/homework mills, gambling without proper licensing, unlicensed financial, lending, real estate, or legal services, NFT/crypto pump schemes, and any product or service prohibited by our payment processor (Creem) or by applicable law.
- Adult-industry promotion— including marketing copy, landing pages, ad creative, or campaigns for pornography, escort services, adult dating, "OnlyFans"-style platforms, sex toys marketed in an explicit manner, or any product whose primary purpose is adult sexual gratification.
- Content marketed as "uncensored," "no filter," "NSFW," "18+," or "unfiltered" — Markey does not offer, and you may not represent that Markey offers, an uncensored or unfiltered generation mode.
- Malware, surveillance, and security-circumvention content — including code, instructions, or marketing for malicious software or systems designed to surveil people without consent.
- Content that infringes intellectual property, privacy, or publicity rights of any third party.
- Any content that violates applicable law in your jurisdiction or in the jurisdictions where the content will be published.
Generation requests that match these categories may be blocked automatically by our moderation systems. We reserve the right to review prompts and outputs for safety purposes, suspend or terminate accounts that attempt to generate prohibited content, and report illegal content to law enforcement. 7. AI-Generated Content Disclaimer
Content generated by Markey is produced by AI and may require review and editing before publication. We do not guarantee that generated content is free from errors, fully original, or suitable for all purposes. You are responsible for reviewing and approving all content before use.
8. Service Availability
We strive to maintain high uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.
9. Payment & Billing
Paid plans are billed in advance on a monthly or annual basis. Refunds are handled on a case-by-case basis. We reserve the right to change pricing with 30 days notice to existing customers.
10. Termination
We reserve the right to suspend or terminate your account, with or without notice, if you violate these terms — and immediately and without refund if you attempt to use the Service to generate or distribute prohibited content as described in Section 6. You may cancel your account at any time. Upon cancellation, your data will be retained for 30 days before permanent deletion.
11. Limitation of Liability
To the maximum extent permitted by law, Markey shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
12. Changes to Terms
We may modify these terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect.
